Terms of Use

These Terms of Use govern your use of freemyats.com (the "Site"). The Site is operated by Free My ATS ("we", "us"). By using the Site or submitting a form on it, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Site.

1. What the Site is

Free My ATS is an advocacy campaign about access to hiring data held in applicant tracking systems. The Site provides information, email and social media templates, a way to show support, and a way to report fees. It is not legal, financial or professional advice. Nothing on the Site says or implies that any particular vendor has done anything unlawful. Unless we say so explicitly, we are not affiliated with or endorsed by any applicant tracking system vendor. Free My ATS is run by a company in the recruiting technology industry, which has its own interest in the issues the campaign addresses.

2. Who can use the Site

You must be at least 18 years old to submit a form. If you submit information on behalf of a company, you confirm that you are authorized to do so.

3. What you submit

When you join the movement or report fees, you agree that:

• The information you provide is accurate and is yours or your company's to share.
• You will not submit information you are not permitted to disclose, including information covered by a confidentiality clause, non-disclosure agreement or other contract with your vendor. It is your responsibility to check your agreements before reporting pricing or contract terms.
• You will not submit anything unlawful, misleading, defamatory or that infringes anyone's rights.
• Any logo you upload is one you have the right to share.

4. Permission to use your submissions

Supporters. If you choose to be shown as a supporter, you give us a non-exclusive, royalty-free permission to display your company name, logo and website on the Site and in materials about the campaign. We review supporters before publishing anyone, and we may decide not to publish a submission. You can withdraw this permission at any time by emailing us; we will remove your listing within a reasonable time, but we can't recall materials already shared.

Reports. Reports are private. You permit us to use them to produce aggregated or anonymized statistics (for example, "212 companies report per-call fees"). We will not publish your name, your company or details that identify either.

5. Acceptable use

Don't use bots or scripts to submit forms, submit false information or impersonate anyone, scrape the Site, try to gain unauthorized access, or interfere with how the Site works. We may limit or block access to enforce these Terms.

6. Our content

The Site's design, text and graphics belong to us or our licensors. You are welcome to copy, adapt and share the email templates, social posts and share image to support the campaign. Anything you send using a template is your own message, and you are responsible for it.

7. Links to other sites

The Site links to third-party services such as LinkedIn and X. We don't control them and aren't responsible for their content or practices.

8. Disclaimers

The Site and everything on it are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. Information on the Site about pricing or industry practices may be incomplete, out of date or based on reports we have not verified.

9. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data or goodwill, arising from your use of the Site. Our total liability for any claim relating to the Site is limited to US$100.

10. Indemnity

You agree to indemnify and hold us harmless from claims, losses and expenses (including reasonable legal fees) arising from what you submit to the Site or from your breach of these Terms.

11. Changes and termination

We may change these Terms by posting a new version on this page with a new effective date. Continuing to use the Site after a change means you accept it. We may change, suspend or end the Site or the campaign at any time.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be heard in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.
